Facebook announced a pair of changes to the privacy settings for teen users on Wednesday. On the plus side, teens' post will now be shared with a smaller group of people by default. On the potentially problematic side, they'll also be able to share things with the public for the first time.

Windows 8.1 Will Start To Roll Out Tomorrow At 4 AM PDT


Tomorrow, at 4 a.m. Pacific Daylight Time, Windows 8.1 will begin to roll out as an optional update to Windows 8 users. The new software represents a reset and rebirth of the bets that Microsoft made with its Windows 8 operating system.


Windows 8.1 contains a grip of new features, including new built-in applications, fresh user-interface changes, and a more powerful search technology that elevates Bing as a component of the Microsoft services suite. SkyDrive also has a prominent place in Windows 8.1, as Microsoft works to ensure that it continues to manage its users’ files wherever they are stored. Trust me, you want to upgrade. Windows 8.1 is to Windows 8 as Office 2010 is to Office 2007.


I’ll be running through the final code tomorrow (Microsoft did not provide TechCrunch with a copy of the final build) and covering the larger launch itself. However, as this is a staged rollout, not everyone will see the code at 4 am Pacific tomorrow. The new operating system will pop up as an update in the Windows Store at various times, depending on your location. All you have to do is have a fine sleep, and when you wake up, the operating system will either be ready for you to snag, or on the way.


Windows 8.1 is even more services-dependent than Windows 8, which opens up more potential fail points – if SkyDrive, Bing, Skype or other services falter tomorrow, it will mar the release of the operating system itself. That said, Microsoft services have been more or less stable of late.


What will be interesting is whether most Windows 8 users switch to Windows 8.1, and at what pace. We’ll be able to track Windows 8.1′s market share independently, but I suspect that Microsoft will share a few statistics as they become relevant and aggrandizing.


So tonight marks the calm before Storm 8.1. Will consumers react positively? Will the new code spur sales? Will it sit well with the new hardware that is on the way? In about 16 hours, we’ll start answering those questions.

Midshipman accused of sexual assault joins call for superintendent to recuse himself

Lawyers for a Naval Academy midshipman facing court-martial on sexual assault accusations have joined a lawsuit — filed by the accuser — to have the Naval Academy superintendent overseeing the case recuse himself.

Counsel for Midshipman Josh Tate, one of the two midshipmen referred to court-martial in an alleged rape case, filed a motion to intervene on an existing lawsuit. The suit, filed by the accuser in the case, requests that Vice Adm. Michael Miller step aside from the proceedings. 

Susan Burke, the accuser's lawyer, filed the suit in early September because she said Miller would be biased against his client in determining whether to refer the men she accused of raping her to court-martial. Burke said Miller was actively intending to retaliate against her client for harming the Naval Academy. 



But now, Tate's lawyers are filing a motion to intervene in the case, which would legally associate themselves as agreeing with the accuser in the lawsuit to get Miller to recuse himself.

"Plaintiff seeks a court order directing the Superintendent to recuse himself from serving as the convening authority in the pending criminal action because 'the probability of actual bias on his part is too high to be constitutionally tolerable.' Intervenor [Tate] seeks the same relief," the motion reads. 

In their motion, filed on Tuesday, the lawyers noted that even though Miller has already made his decision on the court-martial, he still has significant influence in the court-martial, given that he will be able to choose the jury pool.

"The Superintendent’s bias impacts more than just the decision to refer charges to a general court-martial – it impacts the fundamental fairness of the general court-martial itself," the motion read.

Miller recommended last Thursday that two of the three midshipmen accused of raping the female midshipman face court-martial, despite the recommendation of the judge in a preliminary hearing, who said none of the three men should be prosecuted. 

Lawyers for Tate argued in Tuesday's motion that Miller was acting in a time of "relentless" political pressure. 

"It is important to note that the allegations against Intervenor [Tate] unfortunately arise within a turbulent political environment. Currently, the United States Armed Forces are in a well-reported spotlight concerning their alleged treatment of sexual assaults. The political pressure concerning sexual assaults in the military is relentless," the motion said.

"It is not unreasonable to believe that a politically, but not legally, appropriate thing to do would be to subject a young man to an unwarranted prosecution and jeopardy under the assumption that the accused would likely be acquitted."

Tate, Eric Graham and Tra’ves Bush, each a former member of the Academy's football team, are accused of raping the woman after she passed out drunk at a party at an off-campus residence on April 14, 2012. 

Chip Herrington, counsel for Graham — the other midshipman facing court-martial — said he is "supportive" of Tate's lawyers' course of action and is "contemplating similar motions." 

Herrington said he agreed that Miller lost credibility when he recommended the two Midshipmen face court martial against the investigating officer’s suggestion. 

"It is clear that Vice Admiral Miller simply can’t handle the truth shown by his rejection of the judge’s findings in the Article 32 hearing," Herrington said. 

The case is one of the highest-profile military sexual assault cases since President Barack Obama made his first public condemnation of such actions at the Naval Academy’s commencement ceremony in May.

The results of this case, and others like it, may have policy implications for how the military deals with reports of sexual assault, which have increased exponentially in recent years. A Pentagon study estimated that unwanted sexual contact in the military jumped by 37 percent in 2012 to 26,000 cases.

Minaj channels high-end faves for affordable line

LOS ANGELES (AP) — Nicki Minaj knows celebrities-turned-designers aren't always taken seriously in the fashion world, but she doesn't mind.


At a launch event Tuesday for her Kmart collection, Minaj said skepticism of stars lacking formal design training is "understandable," but she insists it's "not about being a designer."


The "Starships" rapper says her intention is simply to make clothes that she would love to wear.


The line for Kmart and shopyourway.com features midriff-baring tops, patterned leggings and curve-hugging dresses, as well as jewelry, clutches and bejeweled caps.


There's also a pink velour track suit and a faux fur trapper hat.


Minaj says Chanel, Versace and Herve Leger were among her inspirations.


Prices range from $3.99 for a studded bracelet to $37.99 for a light wash, denim jacket.

Here's a way to stop hungry shoppers from leaving the store for dinner.


Brooks Brothers, the 195-year-old luxury apparel company, is looking to open a restaurant next summer next to its flagship store in Manhattan, a company spokesman tells NPR. The New York Post reports that the restaurant will be a steakhouse — a fitting culinary accompaniment for the purveyor of fine business suits for the moneyed set, we think.


And it's not the only high-end retailer that's jumped into the food business. Ralph Lauren has a restaurant next to its location off Michigan Avenue in Chicago and another in Paris. (Ironically, the Chicago incarnation features French-inspired dishes like escargot, steak tartare and bouillabaisse, while Paris' menu has a whole page for burgers and steaks.)


Tommy Bahama, a lifestyle clothing line with a tropical twist, has restaurants in about a dozen stores, serving seared ahi tuna and rum mojitos. At some megasized locations of outdoor recreation retailer Bass Pro Shops, customers can order hand-breaded alligator and catfish at an attached seafood grill.


Restaurants can be a terrific traffic driver, says Rob Goldberg, Tommy Bahama's senior vice president of marketing — diners peruse the merchandise while waiting; shoppers might stick around for a drink.


They also give companies another way to express their brand: not just through the colors and feel of the clothing, but also through the flavor and aroma of food, Goldberg says. "For us, the restaurant is a really rich way to tell our lifestyle story because it touches all the senses."


Pairing clothing with food is nothing new: The former Marshall Fields in Chicago opened a restaurant on the seventh floor back in 1905, and other department stores like Macy's and Nordstrom also offer dining options. Even Ikea has a Swedish food market.


But these more recent ventures into dining are part of a larger trend in experiential brand management, says Eric Anderson, marketing professor at Northwestern University.


"A lot of retailers are focusing heavily on managing their brands through the customer experience," Anderson says. "It's no longer just the product they sell."

Examples of this are abundant. Anderson pointed to Whole Foods Market: It's not just a place where his students shop for groceries, he says — it's also where they go on dates.


Or there's outdoor retailer REI, whose flagship store in Seattle has a climbing wall. Or luxury automaker Bugatti, which launched a collection of men's clothing and accessories during Milan Fashion Week, according to the Wall Street Journal.


Urban Outfitters Inc. — which owns its namesake hipster stores, as well as Anthropologie and house-and-garden store Terrain — is pursuing plans in a town near Philadelphia to build an entire shopping village. A local government official we spoke with says it's still just a concept, but the 6.5-acre site could include an Anthropologie, Terrain, boutique hotel, spa or exercise studio and several restaurants.


Granted, not every clothing company should be launching a diner, Anderson says. "If your core competence is in apparel, what business do you have running a restaurant?"


Still, the food venture has worked for Tommy Bahama, Goldberg says: Retail locations with a restaurant attached have, on average, a 20 to 25 percent lift in sales. He says people "try the restaurant on for size" before trying on, say, a shirt.


But he acknowledges the stakes are high — especially when it comes to food. Diners are unforgiving. One tasteless dish, rude server or long wait time could mean that a customer doesn't return to the food or the shirts.


"In a restaurant, we're making a product every 11 minutes with perishable goods," Goldberg says. "And every single plate is a reflection of your brand."

Kate Winslet: Baby Bump Beauty in London

She’s coming up on her third trimester, but that’s not stopping Kate Winslet from going about her normal business.


The “Titanic” actress donned a black maternity dress and stepped out in Central London the day after premiering her new flick “Labor Day” at the 57th BFI London Film Festival.


Of her role in the movie, Kate told press, "I haven't really played a character who was so obviously weak in so many ways."


“That was intriguing to me. But I admired her strength as well and I felt it was very important that she was strong, because I think that we all have the capacity to be both of those things, no matter how broken a person can sometimes be."
